Terms of Service

Effective date: October 8, 2026

These Terms govern your use of APEX ACADEMIC LAB, an online service that sells AI-generated digital learning materials (practice questions, workbooks, answer keys and PDF files) and AI-assisted essay grading through prepaid Credits bought with one-time payments.

1. Purpose and Acceptance

These Terms of Service ("Terms") set out the rights, obligations and responsibilities between APEX ACADEMIC LAB (the "Company") and its members in connection with the APEX ACADEMIC LAB website and related services (the "Service").

By creating an account, purchasing Credits or otherwise using the Service, you agree to these Terms and to our Privacy Policy.

2. Definitions

  • "Service": the online platform that generates digital learning materials for curricula such as the Digital SAT, ACT, AP, SSAT and ISEE, and provides AI-assisted essay grading.
  • "Member": a person who has created an account and agreed to these Terms.
  • "Digital Content": question sets, explanations, answer keys, PDF files, grading reports and other materials generated or provided through the Service.
  • "Credits": prepaid units used to generate Digital Content or request grading. The credit cost of each feature is shown before you use it.
  • "Credit Package": a bundle of a fixed number of Credits sold for a single one-time payment.

3. Posting and Amendment of These Terms

The Company posts these Terms on the Service so that members can review them at any time.

The Company may amend these Terms to the extent permitted by applicable laws, including the Act on the Consumer Protection in Electronic Commerce and the Act on the Regulation of Terms and Conditions. Amendments are announced with their effective date and reasons at least 7 days in advance, or at least 30 days in advance for changes that are unfavorable to members.

If you do not agree to an amendment, you may stop using the Service and delete your account. Continuing to use the Service after the effective date means you accept the amended Terms.

4. Account Registration

  • You may sign up with an email address or a supported third-party login. You must provide accurate information.
  • Children under the age of 14 may only sign up with the consent of a parent or legal guardian.
  • You are responsible for keeping your login credentials secure and must notify the Company promptly of any unauthorized use of your account.
  • Accounts are personal. You may not share, sell, lend or transfer your account or Credits to another person.

5. The Service and AI-Generated Content

The Service uses artificial intelligence to generate original practice materials and essay feedback. Digital Content is delivered immediately on screen and as downloadable files once a request is completed.

AI-generated content may contain errors or inaccuracies. Please review materials before using them for instruction or assessment. Scores from the essay grader are practice estimates and do not predict or guarantee official exam results.

SAT®, AP®, ACT®, SSAT® and ISEE® are trademarks of their respective owners. These organizations are not affiliated with, and do not endorse, the Company or the Service.

6. Credits and Payment

The Company currently offers the following Credit Packages. Each package is purchased with a single one-time payment in U.S. dollars. The latest prices are always shown on the Buy Credits page.

Credit PackageCreditsPrice (USD)
Starter Pack150USD 29.99
Pro Pack400USD 69.99
Master Pack850USD 129.99
  • New members receive 10 free welcome Credits once.
  • Every purchase is a single one-time payment: you are charged only when you choose to buy a Credit Package, and never again unless you make another purchase.
  • Payments are processed by PayPal through the PortOne payment gateway. PayPal payments require a PayPal account. The Company does not receive or store your card number.
  • The package's Credits are added to your balance right after a successful payment, stack with any Credits you already have, and remain available while your account is active. Credits have no cash value and cannot be transferred or exchanged for cash.
  • The credit cost of each feature is displayed before you use it. If a generation or grading request fails because of a Service error, the Company will not charge, or will restore, the Credits for that request.
  • The Company will announce price changes at least 30 days in advance. New prices apply to purchases made after the effective date and do not affect Credits already purchased.

7. Withdrawal and Refunds

  • Refund of unused purchases: If you request it within 7 days of a purchase and none of the Credits from that purchase have been used, the amount paid is refunded minus Payment Processing Fees (PayPal and card network fees), because of the nature of digital content and because payment providers do not return their fees on refunds.
  • No refund after use: Because of the nature of digital content and services, no refund (including partial refunds) is available once even a single Credit from a purchase has been used.
  • Legal basis: Under Article 17(2) of the Act on the Consumer Protection in Electronic Commerce, withdrawal is restricted for Digital Content once its provision has begun, because it cannot be returned after delivery. Payments made more than 7 days ago are also non-refundable.
  • Defective content: If Digital Content differs from its description or cannot be used because of a defect, you may request restoration of the Credits or a refund within 3 months of receiving it, or within 30 days of when you became aware (or could have become aware) of the issue.
  • Payment errors: Duplicate or erroneous charges are refunded in full, including Payment Processing Fees.
  • Processing: Approved refunds are processed within 3 business days through the original payment method. The time for the refund to appear depends on the payment provider or your card issuer.

Full details are in our Refund Policy (/refund). To request a refund, email apexacademylab@gmail.com with your account email address and the payment date.

8. Intellectual Property and License

The Service, including its software, design, templates and Digital Content (excluding materials you submit), is owned by the Company or its licensors.

Subject to these Terms, the Company grants you a non-exclusive, non-transferable license to use Digital Content you generate for your own study or for teaching your own students and classes, including printing and distributing copies to them.

You may not resell, sublicense, publish for sale or redistribute Digital Content at scale (for example, as a commercial question bank or paid workbook) without the Company's prior written consent.

You keep all rights to the materials you submit, such as prompts, passages, essays and uploaded files. You grant the Company a limited license to process them only to provide the Service, and you confirm that you have the right to submit them.

9. Prohibited Conduct

You must not:

  • access the Service without authorization, or scrape, reverse engineer or overload it;
  • circumvent or manipulate the credit, payment or security systems;
  • upload unlawful content or content that infringes the rights of others;
  • impersonate another person or provide false information;
  • use the Service to commit academic dishonesty, such as submitting generated content as your own work where this is prohibited;
  • sell, share or transfer accounts or Credits.

10. Service Changes, Suspension and Termination

  • The Company may change or discontinue features with prior notice, and may temporarily suspend the Service for maintenance, system failures or other unavoidable reasons.
  • If the Company permanently discontinues the Service, it will give at least 30 days' notice and refund paid, unused Credits on a pro-rata basis.
  • If you violate these Terms, the Company may restrict or terminate your account after notice, or immediately in serious cases.
  • You may delete your account at any time. Unused Credits are forfeited on deletion unless they are eligible for a refund under Section 7 (Withdrawal and Refunds).

11. Disclaimers and Limitation of Liability

The Company is not liable for damages caused by force majeure, by the member's own fault, or by outages of third-party services that are beyond the Company's reasonable control.

Except in cases of the Company's intent or gross negligence, and to the extent permitted by law, the Company's total liability is limited to the amount you paid for the Service in the 3 months before the event giving rise to the claim.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Korea. Disputes are subject to the competent court under the Civil Procedure Act of Korea.
